Carrolls Irish Gifts and Irish Landowner (‘we’, ‘us’, ‘our’) have partnered  for a promotion that will run in all Carrolls Irish Gift shops and online www.carrollsirishgifts.com To facilitate this promotion Irish Landowner has set up a new website called  www.carrollsirishland.ie This website is owned and managed by Irish Landowner.

Each Carrolls customer (‘you’, ‘they’) will receive a Free Irish Landowner Wallet and Gift Card  when they spend 50 euro in Carrolls stores or online. To complete registration of their piece of land customers will then go to www.carrollsirishland.ie to redeem their Gift Card and to receive their Irish Landowner Certificate and Plot Number.

This document (together with the documents referred to in it) sets out the Terms and Conditions on which Carrolls Irish Gifts give their customers a Free  IRISH LANDOWNER Wallet, Gift Card and Certificate, ( the ‘product’ ) when they spend 50 euro or more in their stores.

Welcome to our website. These Terms and Conditions apply to the Domain name www.carrollsirishland.ie (the website) and to any correspondence by email  ([email protected]) between us  and the customer . Please read these Terms and Conditions carefully before using the website. Using the website indicates that you accept these Terms and Conditions and our Privacy Policy which is outlined at the end of this document. If you do not accept these Terms and Conditions and our Privacy Policy do not use our website.

By accessing any part of the Website you shall be deemed to have accepted these Terms and Conditions and our Privacy Policy  in full. If you do not accept these Terms and Conditions and our Privacy Policy in full you must leave the website immediately.

We endeavour to ensure that the information on the website is correct and accurate. We can make changes to the material on the website at any time without notice.

When using our site you accept that communication with us will be mainly electronic. We will contact you by email [email protected] or provide you with information  by posting notices on our site. You agree to this electronic means of communication and you acknowledge that all notices, information, and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing.

You should understand that by receiving this product you agree to be bound by these Terms and Conditions and the Privacy Policy.

Redeeming Your Gift Card and Registering Your Plot Number

To complete Ownership of your Plot Number you must go to www.carrollsirishland.ie to Redeem your Gift Card and to receive your Certificate and Plot Number. When you log onto www.carrollsirishland.ie  you will submit your Gift Card Code which is located at the back of your Gift Card in the scratch panel. You will then submit your name and email address. The IT system will create a PDF file which contains your Irish Landowner Certificate. You will download and open this PDF  file. You can then print off your Certificate or save it to your device. You can print off your Certificate in A4 or Letter size, you just need to adjust your settings. Certificates are produced in A4, but can be fitted to letter size at print time. The PDF file contains the full certificate and when printed with “fit” or “actual size” will print correctly. Please refer to our FAQ’s for instructions to print your Certificate.

You will then receive an email stating your Gift Card Code, Plot Number and instructions if you need to reprint your certificate. To reprint your Certificate you will need your gift card code and email you used when you downloaded your first certificate.We will then register your Plot Number and your details in our database. All your data information is completely secure, refer to our Privacy Policy, 2019 below.  If you do not Redeem your Gift Card and receive your Certificate and Plot Number online Irish Landowner will not be in a position to hold your Plot Number.  Irish Landowner will hold the Plot Number for you, the Certificate Owner from March 2014 by way of a 100 year lease and as per these Terms and Conditions. The benefit of this structure is that responsibility for the land remains with IRISH LANDOWNER and not the Owner of the Plot Number.

We accept no responsibility or liability for any injury, damage or loss arising out of your use of the land or the Plot Number or in connection with your visiting the land at the foothills of Muckish Montain. Moyra Glebe, Falcarragh, County, Donegal, Ireland. You will have no right to use the land for any purpose what so ever. Whereas each IRISH LANDOWNER Certificate has a specific Plot Number, the Plots will not be demarcated on the ground. No liability for the land attach to the owner of the Plot Number, all liability for the land attaches to IRISH LANDOWNER.

The Irish Landowner Wallet and  Gift Card cannot be exchanged for cash or replaced when stolen or damaged. Irish Landowner will not be liable for lost, stolen or damaged Wallets and  Gift Cards. Irish Landowner reserves the right to amend these terms and conditions at any time.

Our Liability

In all circumstances the maximum amount of our liability to you will be the product. We shall not be liable for any losses that fall into the following categories.

  • Loss of income or revenue
  • Loss of business
  • Loss of profits
  • We take no responsibility for any loss or damage suffered as a result of our ‘on line’ service or products supplied using it, except as required by law.

Exclusion of Liability

Irish Landowner and Carrolls Irish Gifts  and any other party whether or not involved in creating producing maintaining or delivering the website , directors, exclude all liability and responsibility for any amount or kind of loss or damage that may result to you or a third party including without limitation any direct indirect punitive or consequential loss or damages, or any loss of income, profits goodwill, data, contracts, use of money or loss or damages arising from or connected in any way to business interruption , and whether in tort including without limitation negligence , contract or otherwise in connection with the website in any way or in connection with the use inability to use or the results of use of the website , any websites linked to or from the website or the material on such websites, including but not limited to loss or damage due to viruses that may infect your computer equipment software, data, or other property on account of your access to , use of , or browsing the website or your downloading of any material from the website or any websites linked to the website. Nothing in these Terms and Conditions shall exclude or limit our liability for any liability which cannot be excluded or limited under Irish Law.

Notice

All notices given by you to us must be given to us at [email protected]  We may give notice to you at the email address you provide. Notice will be deemed received and properly served when posted on our website or 24 hours after an email is sent. In providing the service of any notice it will be sufficient to prove in the case of an email , that such email was sent to the specified email address of the addressee.

Events Outside our Control

We will not be liable or responsible for any failure to perform or delay in performance of any of our obligations, under a contract that is caused by events outside our reasonable control (Force Majeure Event).

A Force Majeure Event includes any act , event, non happening, omission or accident beyond our reasonable control and includes in particular without limitation the following:

  • Civil Commotion, riot, invasion, terrorist attack, or threat of terrorist attack , war (whether declared or not) or threat or preparation foe war.
  • Fire ,explosion, storm, flood, earthquake, subsidence, epidemic, or other natural disaster
  • Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport
  • Impossibility of the use of public or private telecommunications networks.
  • The acts , decrees, legislation, regulations or restrictions, of any government
  • And Pandemic or epidemic.

Our performance under any contract is deemed to be suspended for the period that the Force Majeure Event continues and we will have an extension of time for performance for duration of that period. We will use our reasonable efforts to bring the Force Majeure Event to a close or to find a solution by which our obligations under the contract may be performed despite the Force Majeure Event.

Severability

If any court or competent authority decides that any of the provisions of these Terms and Conditions or any provisions of a contract are invalid, unlawful or unenforceable to any extent the term will, be severed from the remaining terms , which will continue to be valid to the fullest extent permitted by law.

Reservation of Rights

 IRISH LANDOWNER owns the lands at Moyra Glebe, Falcarragh County Donegal on foot of a 100 year lease which permits either party to the lease to terminate the lease.  IRISH LANDOWNER reserves the right to exercise this termination clause entirely at its sole discretion and without consultation with the consequence that all ownership and rights will come to an end without liability. IRISH LANDOWNER reserve the right to regulate and control all of the lands owned by IRISH LANDOWNER at Moyra Glebe, Falcarragh, County Donegal entirely at our sole discretion and without consultation. These clauses serve to protect Irish Landowner  and owners of Plot Numbers in the event of a change in legislation or in the event that onerous unforeseen obligations are placed on Irish Landowner  or on the owners of the Plot Numbers. Irish Landowner  reserves the right to terminate the website with immediate effect at any time, for example if there is a change in the law that limits our ability to provide the website and/or an event beyond our control stops providing the website i.e. a technical fault.

Law and Jurisdiction

All matters will be governed by Irish Law and will be subject to the jurisdiction of the courts of Ireland

Irish Landowner and Carrolls Irish Gifts (“We” ‘Us, ‘Our’) are a data controller for personal information provided by you the customer/ the data subject, (“You”, ‘Your’) on the website www.carrollsirishland.ie.  We collect Data/information from you which you volunteer when you provide such data to us or via our services with which you interact. We may obtain such other data about you as may be provided to us in the course of our legitimate business activities. We will use this information subject to the General Data Protection Regulation (GDPR) in Ireland and the E.U. This Privacy Policy sets out the basis on which we collect personal information from you or that you provide to us on www.carrollsirishland.ie

  • information i.e name , email and plot number that you provide on www.carrollsirishland.ie for the purpose of redeeming your gift card , receiving a PDF file that contains your certificate, registering your plot number , receiving an email that contains the following information: gift card code, plot number and instructions to reprint your certificate if so required.
  • information that you provide for the purpose of subscribing to the website services on  www.carrollsirishlad.ie  (including name, plot number,  email address);
  • Any emails sent to us by you and any messages received through our online Contact Us form which are recorded and forwarded to the relevant section. Your email address will remain visible to all staff tasked with dealing with the query.

Using personal information

We may use your personal information for the purposes of:

  • Administering our websites.
  • Maintaining our customer data base.
  • Enabling your access to and use of the website services;
  • Notify you of changes to our services.
  • Facilitate redemption of your Gift Card, and you receiving a PDF file which contains your Certificate and Plot Number, which you can save on your device or print off .  Sending you an email containing your Plot Number and Gift Card Code with instructions to reprint your Certificate if so required. 
  • Sending you marketing communications where you have consented to be contacted for such purposes such as Carrolls Irish Gifts Newsletters, Carrolls Irish Gifts Offers.

When you provide us with personal information to redeem your gift card, receive your certificate, complete registration and to sign up for marketing information you have agreed to us collecting your data and using it for that specific reason. If you have consented to the use of your information you have the right to withdraw that consent at any time. By agreeing to our Terms and Conditions you are agreeing to our Privacy Policy. You have given us consent to use your data as outlined in this policy. By using our website you represent that you are at least the age of majority in your state or province of residence or that you are the age of majority in your state or province of residence and you have given us your consent to allow your minor dependents to use this site.

  • We only provide the information that they need to perform their specific services. They may only use your data for the exact purposes we specify in our contract with them. Examples of why we share your data are: IT support company,Your Local Biz  help to ensure that www.carrollsirishland.ie is fully operational  for our customers and our businesses.
  • We share customer data to facilitate customers redeeming their gift cards, receiving their certificate,registering their plot number, receiving an email that contains their plot number, gift card number and instructions on how to reprint their certificate.
  • We share customer data to address any customer queries or complaints.
  • We share customer data to maintain our customer databases.
  • We share customer data for marketing purposes namely signing up to Carrolls Irish Gifts Newsletter and promotions.

www.carrollsirishland.ie  is stored and secure on secure servers in Blacknight, Ireland and protected by SSL Certificate during transmission.

We use a variety of security technologies and procedures to help protect your information from unauthorised access., No physical or electronic security system is entirely secure. We cannot guarantee the complete security of our databases , nor can we guarantee that information that you supply will not be intercepted while being transmitted to us over the internet.

Right To Access, Amend And Erase Your Information

If you would like to request access to your information or ask that we amend your information or seek to delete your information or register a complaint please contact. us on [email protected]  setting out as much detail as possible.
